If you have recently settled a personal injury accident case where you were injured in an automobile accident in New York State, read this to make sure that you have been fully compensated for every aspect that you are owed. “EIP” is short for the eligible injured person in the insurance industry. If you are hurt in an automobile accident, you are the “EIP.” The insurance company is also known as the “no-fault insurance carrier,” and your contract stipulates that you have what is known as a first-party benefit. If your claims were denied, you might still be entitled to compensation for your injuries.
The New York State No-Fault Statute Dictates That Eligible Injured Parties May Be Entitled to the Following benefits:
Medical Benefits: All required medical expenses resulting from your accident are covered.
Lost Earnings: You are entitled to 80% of your lost wages lost for up to 36 months following your accident. The monthly cap for recompensation is $2,000. You might be entitled to more if you purchased additional lost wage protection.
Reasonable and Necessary Expenses: You may receive up to $25 per day beginning the day after the accident, but the benefits are capped at one year.
Death Benefit: Death benefits are payable at up to $2,000 over the basic no-fault limit, which is $50,000. Death benefits will be paid to the estate of the deceased.
Which EIP Claims Can Be Recovered if the No-Fault Insurance Carrier Denies Them?
