Hit and Run Accident Attorney

A hit and run accident is the act of causing or contributing to a motor vehicle accident and failing to stop and identify oneself after the accident.

Despite New York State laws, which make it illegal to leave the scene of a car accident involving injury to a person or property, drivers often attempt to flee the scene of an accident. In 2017 alone,  there was about 46,000 hit and run cases in New York City. These accidents also affect pedestrians and cyclists at an alarmingly high rate, making up 65% of all hit-and-run fatalities.

Our firm understands how accidents involving hit and run drivers can cause more than just physical injuries. It is possible to experience severe emotional trauma, feelings of helplessness, PTSD, anxiety, and anger. Our support staff is here to assist you. We want to hear your story and help you recover your losses.

If you are injured in a motor vehicle accident caused by a hit and run driver, you may be entitled to recover your losses, even if the other driver is not found. What to Do After a Hit and Run Accident in New York

After a regular car accident, your New York car accident attorney would recommend you trade information with the other driver so you and your lawyer can work with their insurance company to get the compensation you deserve. Of course, this isn’t really an option if the other driver flees, at least not before they’re caught. However, as is the case in all car accidents, there are a few steps you should still take. These include:

1. Get to a Safe Location and Check for Injuries

After the collision, pull over to the side of the road if your car is still operational. Do not delay getting a full medical evaluation. Check yourself and any passengers in the car for any injuries. If there are any serious injuries, do not move the injured person, request an ambulance or go to the Emergency Room immediately. However, if your car is not operational, and there are only minor injuries, safely make your way to the side of the road.

Even if you do not feel immediate pain or are unsure about your condition, seek medical attention within the next 24 hours. You want a complete diagnosis and record of all of your medical conditions. Provide the examiner with statements about your pain and any difficulty moving so that the information is on your documentation.

2. Call 9-1-1

After you’re in a safe location, be sure to call 9-1-1. Make sure they send an ambulance so you can receive medical treatment at the scene of the accident. When the police arrive, provide a statement of what happened, making sure you only tell them what you know for a fact. For example, you might say a driver rear-ended you then fled, but saying they were texting at the time would likely be conjecture, and should be avoided in the report.

3. Document & Gather Evidence at the Scene

The moments immediately following a collision are critical. The more information you gather, the stronger your case will be. Memories fade quickly under stress. As soon as you have a moment to collect your thoughts, use your phone’s voice recorder or a notepad to document every detail you can recall. Once you have gathered your notes and recordings, compile them into a formal written statement. Ensure it is as clear, objective, and detailed as possible.

Identify the Other Vehicle and Driver

Try to recall as many specific details as possible. You are looking to identify both the vehicle and the person behind the wheel.

  • Vehicle Details: Note the license plate number, color, and the estimated make and model.
  • Defining Characteristics: Look for unique features like a large brush guard, CB radio antenna, mismatched body panels, or stickers in the windows.
  • Damage Location: Note exactly where the other vehicle was impacted.
  • Driver Description: Try to remember a physical description of the driver or any notable traits.

Capture Photo and Video Evidence

Before leaving the scene, use your phone to take comprehensive photos and videos. Visual evidence is difficult to dispute later.

  • The Damage: Capture clear shots of the damage to your car and any injuries you sustained.
  • The Environment: Photograph road conditions, street signs, weather, and anything else that may have contributed to the collision.
  • The Debris: In the event of a hit-and-run, take photos of any debris (like glass or paint chips) that could have come from the fleeing vehicle.

4. Talk to Any Witnesses Around

If your accident happened in the city, chances are there were at least a few pedestrians who saw the collision happen. If you can, talk to them about what they saw. Take their statements, and get their contact information so you and your lawyer can talk to them later.

5. Call Your Insurance Company

Unfortunately, you will need to report the accident to your insurance company. When you call them, answer their questions as succinctly as possible. They will be looking for any reason to lessen the amount they pay you if you suffer serious injury. Simply tell them that you were in a hit and run accident, plus when and where the collision occurred.  Tell them you will be consulting an attorney who can provide more detail.

6. Contact a Hit & Run Accident Lawyer

Dealing with the insurance company and getting the compensation you deserve after a hit and run accident can be an uphill battle. It can feel like law enforcement and insurance aren’t doing everything they can to help you. That’s why it’s so important to speak with a New York hit and run lawyer as soon as possible after your wreck.

An experienced New York car accident attorney does more than offer advice; they provide the resources and legal leverage necessary to uncover the truth. Using a deep understanding of local infrastructure and investigative techniques, your legal team can proactively:

  • Secure Critical Evidence: Requesting surveillance footage from nearby businesses, toll booths, and municipal traffic cameras before it is overwritten.
  • Deploy Specialized Experts: Coordinating with private investigators and forensic specialists to identify the fleeing vehicle through road debris, paint transfer, and witness descriptions.
  • Maximize Financial Recovery: Beyond identifying the driver, your attorney explores every avenue for compensation—ensuring your medical bills, lost wages, and pain and suffering are fully accounted for.

Who Pays For Damages After a Hit and Run Accident in New York?

No-Fault Insurance, Uninsured Motorist Coverage

In every case, you will be able to file for your basic economic losses under your own no-fault insurance policy. This policy provides you up to $50,000 in medical treatment coverage as well as partial reimbursement of your lost wages. Where the driver/vehicle involved in the hit and run cannot be identified, Uninsured motorist policies will, in most instances, cover hit and run accidents and the damages from the same, as well.

The Guilty Party

If you can identify the driver and establish fault, their third-party liability policy is responsible for paying excess costs of your medical treatment, the remainder of your lost wages, any other uncovered damages, including payment for your pain and suffering.

Other Liable Third Parties

In some cases, you may be unable to identify the driver and vehicle that hit you, but you can identify another third party responsible for your crash. It could be another driver, or it could be the manufacturer of your vehicle. It all depends on the circumstances of your accident.

There are many other possibilities, including the possibility of victim’s compensation or a MVAIC claim, where there are no other sources of insurance available. The important thing is to start gathering evidence now and to speak to a knowledgeable attorney experienced in hit-and-run collisions to explore your options.
