What Is a Personal Injury Claim?
A personal injury claim is a legal action brought by someone injured by another party’s negligence or wrongful conduct. The injured person, known as the plaintiff, seeks compensation from the responsible party (the defendant). These claims can arise from car accidents, motorcycle crashes, dog bites, construction site injuries, and many other situations. Compensation can cover medical bills, lost wages, pain and suffering, and other losses tied to the injury. Most personal injury claims are resolved through settlement negotiations, but some proceed to trial when an agreement can’t be reached out of court.
What Causes Most Personal Injury Claims in Long Island?
Motor vehicle accidents on roads like the Long Island Expressway and Sunrise Highway are the leading causes of personal injury claims in the region. Traffic deaths have risen 40 percent since 2019, with Long Island accounting for 20 percent of all auto accident-related fatalities in New York State. Speeding, distracted driving, and drunk driving are among the top contributing factors. If you’ve been injured in a crash on Long Island, speak with an attorney as soon as possible.
Should I Talk to an Insurance Adjuster?
After an accident, you’ll likely hear from an insurance adjuster, sometimes within hours. Their job is to settle your claim for as little as possible, and anything you say can be used to do exactly that.
You’re not required to give a recorded statement to the other party’s insurance company, and doing so before speaking with an attorney can cause problems with your claim. Even well-intentioned comments about how you’re feeling or what happened can be taken out of context. Before you respond to any adjuster, talk to a personal injury attorney. What Is the Statute of Limitations?
The statute of limitations is the deadline for filing a personal injury lawsuit. In New York, most personal injury claims must be filed within three years of the date of the accident. Some exceptions can shorten this window. For example:
- Claims against a city or municipality require a Notice of Claim to be filed within 90 days of the incident.
- Cases involving medical malpractice must be filed within two years and six months from the date the malpractice occurred or from the end of continuous treatment by the same doctor for the same condition.
The sooner you contact an attorney, the better your chances of preserving evidence, securing witness accounts, and meeting the appropriate deadline.
What Is the New York Serious Injury Threshold?
New York is a no-fault insurance state, which means that after a motor vehicle accident, your own insurance covers your medical bills and a portion of lost wages up to $50,000, regardless of who caused the crash. To sue the at-fault driver for pain and suffering, your injuries must clear what’s known as the serious injury threshold.
Under New York Insurance Law § 5102(d), your injuries must fall into one of nine categories to step outside the no-fault system and pursue a lawsuit. They include:
- Death
- Dismemberment
- Significant disfigurement
- Fracture
- Loss of a fetus
- Permanent loss of use of a body organ or system
- Permanent limitation of a body organ or member
There’s also the 90/180 rule, which defines a serious injury as one that prevents you from performing “substantially all” of your “usual and customary daily activities.” This must occur for at least 90 days out of the 180 days immediately following the accident.
